Passenger injured in crash files suit against driver, vehicle owner

A passenger involved in a January 2010 crash in Minooka filed a suit against the man driving the vehicle she was riding in.

According to Grundy County Circuit Court records, on Sept. 25, Tiffany Markle filed the suit against driver Adam D. Saragossa and vehicle owner Christina M. Borth.

The suit alleges that on Dec. 10, 2010, Saragossa was driving the vehicle north on McLindon Street when crossing railroad tracks and the vehicle flipped. She alleges Saragossa drive at a higher speed than reasonable, failed to decrease speed as he approached the tracks and was otherwise negligent.

In a second count, Markle claims it was Borth’s duty to ensure Saragossa was operating the vehicle safely.

Markle is seeking damages of at minimum $50,000 for her reportedly severe and sustained injuries, pain and medical expenses.

She is being represented by Frank S. Cservenyak Jr. of Joliet.
