A man and woman have filed suit against a woman who struck them in a 2010 crash on Illinois 113, as well as the owner of the vehicle she was driving.

According to Grundy County Circuit Court records, on Oct. 17, Donald A. Kevish and Debra L. Kevish filed a lawsuit against Cynthia M. Kendall-Wood and Mike B. Chuway.

The suit alleges that on Oct. 28, 2010, Donald Kevish was driving east on Illinois 113 near the intersection with Illinois 47 in Morris when Kendall-Wood was traveling behind and struck his vehicle. Debra Kevish was listed as a passenger, and Chuway as the vehicle’s owner.

The Kevishes individually allege Kendall-Wood failed to decrease her speed approaching the intersection and to avoid the collision, failed to give notice of her approach by sounding her horn and was driving at a speed that was greater than what was reasonable.

They also allege it was Chuway’s responsibility that Kendall-Wood was exercising care in operating his vehicle.

The two are seeking at minimum $50,000 in damages for their injuries, loss of normal life and medical expenses.

They are being represented by Frank S. Cservenyak of Joliet.
