Gardner must end lawsuit against GSW High School

Attention Gardner Taxpayers: I would like to bring to your attention a court case by the Gardner Village Board. The village has an ongoing case with Gardner-South Wilmington High School censuring the Gardner TIF.

The village is stating the high school can only spend TIF money on infrastructure. The court ruled the high school can keep spending the TIF as it has for the last 26 years.

After the first ruling, the village went back to the court and asked the case ruling be reviewed. The court reviewed the ruling, and then ruled again in favor of GSW.

Now the village is appealing the Grundy County court ruling to the Appellate Court.

The court ordered the village to pay back TIF funds that were owed to GSW. The village paid a portion, but also help back a portion of the TIF the high school was owed.

Until all of the TIF owed is paid, the village will have to pay interest on the unpaid portion. Eventually, all the funds will have to be paid to the high school, regardless of a court ruling.

As taxpayers of Gardner, we are paying for the village’s layer fees. We are also paying at least one-third of the high school’s lawyer fees. This is in the THOUSANDS OF DOLLARS!

If this case continues, the only ones that will gain will be the lawyers for the village and the high school.
